Artwork Release Submission Terms and Conditions
365 Foundation, Inc. Artwork Release Form
I, _______________________________, hereby give the 365 Foundation, Inc. and their legal representatives and assigns the right and permission to publish my name, company, and artistic work for the purpose of publication as they see fit (including, but not limited to websites, letterhead, signage, etc.). I also relinquish all my rights to the artwork.
My signature on this release form also serves as my promise, under penalty of law, that I am the designer of this artwork and will provide a clean graphic free of any copyrighted material or artwork. I understand that I can only submit an original art design, not taken or copied from any entities.
In giving my consent, I hereby release and hold harmless the 365 Foundation, Inc., their office, employees, Board Members, and designees from any and all responsibility or liability. I understand I will receive no compensation whether or not my submitted artwork is used. With my submission, I agree that (1) any and all disputes, claims, causes of action, judgments, and awards against the 365 Foundation, Inc. arising out of or connected with the Competition will be limited to actual out-of-pocket costs incurred not to exceed the amount of any Fees; (2) Entrant hereby waives all rights to claim, (i) punitive, incidental or consequential damages, (ii) any and all rights to have damages multiplied or otherwise increased, and (iii) any other damages, other than damages for actual out-of-pocket expenses not to exceed the amount of the Entry Fee.
I understand the 365 Foundation, Inc. has full authority regarding which artwork they use. The 365 Foundation, Inc. is not required nor obligated to use any information or artwork I submit. I understand that submitting this release form and my artwork constitutes my agreement to comply with the 365 Foundation, Inc. Rules. All decisions of 365 Foundation, Inc. regarding any and all aspects of the Competition shall be final and binding in all respects. The 365 Foundation, Inc. reserves the right to change and/or waive the Rules at its sole discretion. 365 Foundation, Inc. reserves the right to cancel the submission process if it determines, in its sole discretion, that fraud, technical failure, and/or other errors have compromised the integrity of the acceptance.
I understand I may not withdraw this release/consent once it has been submitted.
